Rep. Peter Roskam (R-IL) went on with Stewart Varney on Thursday morning to discuss recent developments on Capitol Hill.

Roskam told Stewart House Republicans are planning of filing criminal charges against Lois Lerner.

Rep. Roskam: The Obama Administration was very lenient with the crimes that Lois Lerner committed. And those are strong words that I’m using but the House Ways and Means Committee voted out a criminal referral to the Department of Justice which was completely dismissed by the Department of Justice… We think that Lois Lerner did two things wrong. Number one, she denied people due process and equal protection of the law based on their political philosophy. We’re convinced that there is overwhelming evidence to suggest that that’s true. And that’s a felony. Secondly, we suspect that she lied to the Inspecter General of the Treasury Department.

State Department Employee Arrested and Charged With Concealing Extensive Contacts With Foreign Agents

A federal complaint was unsealed today charging Candace Marie Claiborne, 60, of Washington, D.C., and an employee of the U.S. Department of State, with obstructing an official proceeding and making false statements to the FBI, both felony offenses, for allegedly concealing numerous contacts that she had over a period of years with foreign intelligence agents.



The charges were announced by Acting Assistant Attorney General Mary B. McCord for National Security, U.S. Attorney Channing D. Phillips of the District of Columbia and Assistant Director in Charge Andrew W. Vale of the FBI’s Washington Field Office.



“Candace Marie Claiborne is a U.S. State Department employee who possesses a Top Secret security clearance and allegedly failed to report her contacts with Chinese foreign intelligence agents who provided her with thousands of dollars of gifts and benefits,” said Acting Assistant Attorney General McCord. “Claiborne used her position and her access to sensitive diplomatic data for personal profit. Pursuing those who imperil our national security for personal gain will remain a key priority of the National Security Division.”


“Candace Claiborne is charged with obstructing an official proceeding and making false statements in connection with her alleged concealment and failure to report her improper connections to foreign contacts along with the tens of thousands of dollars in gifts and benefits they provided,” said U.S. Attorney Phillips. “As a State Department employee with a Top Secret clearance, she received training and briefing about the need for caution and transparency. This case demonstrates that U.S. government employees will be held accountable for failing to honor the trust placed in them when they take on such sensitive assignments”

“Candace Claiborne is accused of violating her oath of office as a State Department employee, who was entrusted with Top Secret information when she purposefully mislead federal investigators about her significant and repeated interactions with foreign contacts," said Assistant Director in Charge Vale. "The FBI will continue to investigate individuals who, though required by law, fail to report foreign contacts, which is a key indicator of potential insider threats posed by those in positions of public trust.”

The FBI arrested Claiborne on March 28. She made her first appearance this afternoon in the U.S. District Court for the District of Columbia.

According to the affidavit in support of the complaint and arrest warrant, which was unsealed today, Claiborne began working as an Office Management Specialist for the Department of State in 1999. She has served overseas at a number of posts, including embassies and consulates in Baghdad, Iraq, Khartoum, Sudan, and Beijing and Shanghai, China. As a condition of her employment, Claiborne maintains a Top Secret security clearance. Claiborne also is required to report any contacts with persons suspected of affiliation with a foreign intelligence agency.

Despite such a requirement, the affidavit alleges, Claiborne failed to report repeated contacts with two intelligence agents of the People’s Republic of China (PRC), even though these agents provided tens of thousands of dollars in gifts and benefits to Claiborne and her family over five years. According to the affidavit, the gifts and benefits included cash wired to Claiborne’s USAA account, an Apple iPhone and laptop computer, Chinese New Year’s gifts, meals, international travel and vacations, tuition at a Chinese fashion school, a fully furnished apartment, and a monthly stipend. Some of these gifts and benefits were provided directly to Claiborne, the affidavit alleges, while others were provided through a co-conspirator.

According to the affidavit, Claiborne noted in her journal that she could “Generate 20k in 1 year” working with one of the PRC agents, who, shortly after wiring $2,480 to Claiborne, tasked her with providing internal U.S. Government analyses on a U.S.-Sino Strategic Economic Dialogue that had just concluded.

Claiborne, who allegedly confided to a co-conspirator that the PRC agents were “spies,” willfully misled State Department background investigators and FBI investigators about her contacts with those agents, the affidavit states. After the State Department and FBI investigators contacted her, Claiborne also instructed her co-conspirators to delete evidence connecting her to the PRC agents, the affidavit alleges.

Charges contained in a criminal complaint are merely allegations, and every defendant is presumed innocent until proven guilty beyond a reasonable doubt.

The maximum penalty for a person convicted of obstructing an official proceeding is 20 years in prison. The maximum penalty for making false statements to the FBI is five years in prison. The maximum statutory sentence is prescribed by Congress and is provided here for informational purposes. If convicted of any offense, the sentencing of the defendant will be determined by the court based on the advisory Sentencing Guidelines and other statutory factors.

At her court appearance today, Claiborne pleaded not guilty before the Honorable Magistrate Judge Robin M. Meriweather. A preliminary hearing was set for April 18.

The FBI’s Washington Field Office is leading the investigation into this matter. The case is being prosecuted by Assistant U.S. Attorneys John L. Hill and Thomas A. Gillice for the District of Columbia and Trial Attorney Julie Edelstein of the National Security Division’s Counterintelligence and Export Control Section.

This is how it's done if you want to do it right. I guarantee these people are not comfortably going about their lives, they are nervous wrecks wondering which one is next. Going back as far as Lois Lerner just made many more of them who thought they were in the clear start sweating. Which is exactly why they did it.

Former IRS senior executive Lois G. Lerner told a federal court this week that she faces the possibility of death threats if her role in the tax agency’s tea party-targeting becomes public, and asked a judge to forever seal her upcoming deposition in a class-action lawsuit brought by hundreds of groups that were targeted.

Mr. Lerner and Holly Paz, another figure from the IRS tea party targeting, told the judge they’ve already faced “harassment and death threats” before, and said they fear another media firestorm if their version of events from the tea party targeting were to become public.

The two women said they are willing to testify, but said they could be putting “their lives in serious jeopardy.”

“Mss. Lerner and Paz have demonstrated that the public dissemination of their deposition testimony would expose them and their families to harassment and a credible risk of violence and physical harm,” they said in documents submitted by their lawyer to Judge Michael R. Barrett.

The two women submitted secret evidence to the judge that they said backed up the death threat claim. They said the threats they’ve already gotten contained “graphic, profane and disturbing language” that they said has caused them embarrassment.

The groups suing the IRS in the class action lawsuit have objected to the secrecy order, leaving the matter to Judge Barrett to decide.

Both Ms. Lerner and Ms. Paz are among the IRS figures who’ve been ordered to be deposed in the class action lawsuit. Ms. Paz already gave one deposition in the case in 2015.

The women want that past deposition and their future testimony to remain hidden from the public and only available to the lawyers involved in the case. They asked that the seal be permanent.

Ms. Lerner has refused to talk in public about her role in the targeting, famously engaging in a showdown with the House Oversight Committee after she appeared, delivered a statement of innocence and then balked at answering any questions.

The House eventually voted to hold her in contempt, but an Obama administration prosecutor — acting just hours before his resignation became effective — announced the Justice Department wouldn’t pursue the case.

The Justice Department also cleared Ms. Lerner in a criminal investigation, saying she was one of the first in the IRS to realize they were acting wrongly, and took steps to clean up the mess.

House Republicans asked Wednesday that the Trump administration reopen the case. They say Ms. Lerner obstructed official investigations and pointed to evidence from emails in which Ms. Lerner mocked conservatives and Republicans as evidence of malice, which the GOP said helped foster the environment that led to tea party groups being targeted by the IRS.

The IRS still faces several legal cases stemming from the targeting.

The class action lawsuit involves 428 groups who were snared by the IRS targeting procedures. That case, which is being heard in a federal court in Ohio, is in the discovery phase, and Ms. Lerner and Ms. Paz are supposed to give testimony.

IRS officials also agreed to turn over the system reports it generated for each of the 428 groups targeted.

Meanwhile, in Washington, D.C., two cases brought by tea party groups are proceeding. A judge on Wednesday granted limited discovery in those cases, ordering the IRS to detail its past and current approval processes for tax-exempt organizations.

Judge Reggie B. Walton also said the groups could depose Tamera L. Ripperda, a former IRS employee who ran the Cincinnati office that processed the applications. The groups also can depose the unnamed IRS employee who currently holds that same post.

That doesn't make a lick of sense. Anyone who was harmed by her actions should be happy that she wants to testify. I've seen vids where people confronted her in public, and all they seem to want is answers. The only ones that I'd think wouldn't be happy, is any superiors who told her what to do. What else is there to testify about? She already tried denying it.

There seems to be a faction around here with "CSI" or a movie mentality. If everything is not solved within a hour or two it is a FAILURE or BS move and related to the PROG side aka "Business As Usual", It is NOT BaU.

There are people here with speedboat mentality when the action being created is for an Aircraft Carrier move. Speed boats can turn on a dime, and make laps in Lake or Reservoir races. An aircraft carrier can not even make turn in the average lake, river or reservoir.
This administration is LESS THAN FOUR Months old. There is still bugs and vermin being cleaned outa the closets.

I've been harmed by the IRS.

How many others have also been harmed, and at what point does financial deprivation at gunpoint lead to actual, physical harm?

One of my Liberty Dollar associates committed suicide the day the IRS came to his home to confiscate his silver and gold.

Like me and many others, he suffered intense scrutiny, audits and harassment because IRS "enforcement" is one of the political tools historically used by corrupt POTUS administrations and their Treasury/Bankster handlers.

My IRS nightmare began when Bush the Lesser was POTUS, but my Tea Party affiliations only added torque to the tormentors tools when Barry and his traitorous ilk took the helm.

Bottom line:

Lois, you harmed others under color of authority.

Prepare to be harmed, hounded and exposed for your treachery!

I also hope you rat on your superiors, especially V. Jarrett.
