Ohio jury awards $11 million to bakery owners targeted by Oberlin College student protests
Bakery filed the libel suit after student boycott, allegations of racism

By Valerie Richardson - The Washington Times - Friday, June 7, 2019

The owners of an Ohio bakery who sued for libel after being targeted by student protests won Friday an $11 million verdict against Oberlin College.

A Lorain County jury ordered Oberlin to pay $11 million in compensatory damages to Gibson’s Bakery, a local fixture since 1885 that was beset by protests and racism allegations after three black students were arrested for shoplifting the day after the 2016 presidential election.

“The jury saw that Oberlin College went out of their way to harm a good family and longtime business in their community for no real reason, and the jury said we aren’t going to tolerate that in our community anymore,” Owen Rarric, an attorney for the Gibsons, told Legal Insurrection.

The award, which could triple at Tuesday’s hearing on punitive damages, came as a warning to universities that encourage social-justice activism as student protests spill from the campus to the local community.

“The verdict sends a strong message that colleges and universities cannot simply wind up and set loose student social justice warriors and then wash their hands of the consequences,” said Cornell Law School professor William Jacobson, who runs the conservative Legal Insurrection website.

Bakery owners said they lost business after Oberlin students held protests accusing them of discrimination. The student Senate passed a resolution claiming Gibson’s had “a long history of racial profiling,” and Dean of Students Meredith Raimondo was accused of passing out an anti-Gibson’s flier.

Students boycotted the bakery, while the college cut off and then resumed its contract for baked goods.

Oberlin argued it was not responsible for the students’ actions. Meanwhile, the three students pleaded guilty to shoplifting and aggravated trespass while issuing statements absolving the bakery of racism.

In 2017, Gibson’s sued the college for libel; tortious influence with business relationships and contracts, and intentional infliction of emotional distress, culminating in the nearly month-long trial in Elyria, Ohio.

“The students eventually pleaded guilty, but not before large protests and boycotts intended to destroy the bakery and defame the owners,” Mr. Jacobson said. “The jury appears to have accepted that Oberlin College

The rest of the article...

In a Friday email to the college community, Oberlin general counsel Donica Thomas Varner said the college was “disappointed” with the verdict and would determine how to proceed.

She insisted that the college and Ms. Raimondo “worked to ensure that students’ freedom of speech was protected and that the student demonstrations were safe and lawful.”

“As we have stated, colleges cannot be held liable for the independent actions of their students,” Ms. Varner said. “Institutions of higher education are obligated to protect freedom of speech on their campuses and respect students’ decisions to peacefully exercise their First Amendment rights. Oberlin College acted in accordance with these obligations.”

Mr. Rarric disagreed. “The College kept saying we don’t control our students,” he said. “But the jury told them we can tolerate some of this fro time to time, but not what you did this time.”

The jury’s award included $3 million for Allyn W. Gibson; $5.8 million for his son David Gibson, and $2.3 million for Gibson Brothers.

David Gibson said afterward that the trial had taken a toll on the family and called the verdict “a relief,” as shown in video posted by the Elyria [Ohio] Chronicle-Telegram.

They can afford the judgement, even though they are running a deficit and losing students.

Another good news thread!

Imagine that:

The perps pled guilty, but the f*ckin prof insisted that her students destroy the business.

I hope the punitive damages are 10x the verdict amount of $11 Million FRNs.

Put that useless "educational institution" out of business, and kick that criminal prof to the curb.

Yep! College SHOULD pay and pay and pay. After all, that college is the local epitome of the failure of US higher education. Had they done their job perhaps the whiney loudmouthed and libelous SJW wankers could have realized that the Gibson Bakery was NOT racist and were merely defending their PROPERTY RIGHTS since governments do not. Oberlin should be made an example and collapsed on the ash heap of history. If Oberlin does manage to recover they would do well to fire the professors who teach and encourage this crap and make such "instruction" a permanat grounds for dismissal. Since Oberlin is a residential campus the students should be warned that any silliness off campus and ALL LIABILITY for their actions is on the students AND their parents and that ALL students and parents MUST sign agreements accepting this liability...a requirement FOR ALL colleges and universities across the country. This should put a bit of a cork in all this left liberal LGBTQ/SJW/who knows what other stupidity these asshats fill these kids' heads with. There is NO suppression of free speech here only the common and common sense liabilities for one's own stupidity.

Hell, I hope the court triples the award.

The college is very guilty of involvement, therefore they must be punished, in order to prevent further instances of this nature.

The dingbats who did this have no money, the college had "Deep Pockets", guess who is going to pay, this will end up causing more censorship issues down the line.

The instigators should have to pay a portion as well...i.e., any faculty who encouraged these actions.

Most ESPECIALLY, the SJW prof who instigated the "protests."

It should be drawn and quartered concurrent with the liquidation of any assets.

These are bastions of Higher Education. It is not an ALL or NOTHING situation.
It will be a tale of DYODD before one shoot off their mouth or instigates criminal activity.
There is a term "ETHICS" Politicians and the Educational System (along with most TBTF and International Business) have lost along the way.

Just like businesses pass on business taxes to customers as a part of the cost of manufacture, so colleges and universities will pass on thos4e costs of education through higher tuition and fees and lower pay and reduced benefits to faculty and staff against the stark reality of "staying in business" ala economics 101... always a FAIL for libtards.

Oberlin is a private institution and it costs a small fortune to go there already.
PROGS and LIBS go there. I don't care since they are footing the bill.
Less funds to support their commie causes.

USING Common Sense goes much further and making one pay for a deliberate financial attack is legal in the U.S.

Because the Vice President AND Dean of Students at Oberlin is an AGENT of the college, and incited student involvement. As an AGENT of OBERLIN she placed the college in jeopardy, and a jury agreed.
The COURT did not steal from the college. "We the People" ( a jury trial) decided the college's fate and found it should be held at fault.

HOPEFULLY it becomes $33Million to take from Oberlin College. Hopefully they find the agent personally and separately guilty too and held responsible jointly.
Why are you so adamant about protecting a long established PRIVATE PROG Institution with a "Hate America" philosophy yet call Israel "the real Welfare Queen"?
What I see is YOU have HATE AMERICA mentality too.

On the contrary, America is my first and ONLY love, I reject the concept of dual citizenship. I know that every dime of foreign aid is a dime stolen from America that we need for our own people. Having been warned by Scorpio not to say anything mean about Israel, I won't.

The question is; Does it increase donations to the liberal cesspool or decrease donations because the libs don't want their money spent that way?
Funny they have a choice and neither one will make them happy.

Right. So it is proper that those who attend Oberlin pay more for the levels of stupidity they expect to receive at Oberlin. Sort of like paying upfront for future costs of their stupidity.

A lawyer buddy of mine pointed out sumpin:

CIVIL litigation -- specifically against the assholes in charge at Oberlin -- is readily available and is very likely a slam-dunk.

Oberlin College to pay bakery the now-massive sum of $44M over racism dispute

By Frank Miles | Fox News

A jury has awarded $33.2 million in punitive damages to Gibson’s Bakery, whose owners claimed Ohio’s Oberlin College and an administrator hurt their business and libeled them during a dispute that triggered protests and allegations of racism following a shoplifting incident. (AP)

A jury has awarded $33.2 million in punitive damages to Gibson’s Bakery, whose owners claimed Ohio’s Oberlin College and an administrator hurt their business and libeled them during a dispute over a shoplifting episode that triggered protests and allegations of racism.

The Chronicle-Telegram reported the same jury awarded Gibson’s business and family members more than $11 million in actual or compensatory damages, bringing the total award to more than $44 million.

RACIAL DISPUTE AT BAKERY ROILS LIBERAL COLLEGE TOWN

The Lorain County jury Friday awarded David Gibson $5.8 million, son Allyn Gibson $3 million and Gibson’s Bakery $2.2 million.

The protests occurred after Allyson Gibson, who is white, confronted a black student who’d shoplifted a bottle of wine. Two other black students joined in and assaulted Gibson.

The students pleaded guilty to misdemeanors and read statements in court saying Gibson’s actions weren’t racially motivated.

An attorney said the Gibsons just wanted “the truth to come out.”

Donica Thomas Varner, the college's general counsel, didn’t return Fox News’ request for comment via email.

Last week she said she was disappointed with the verdict and denied the college had defamed the bakery or its owners.

“Neither Oberlin College nor Dean Meredith Raimondo defamed a local business or its owners, and they never endorsed statements made by others," Varner reportedly said.

"Rather, the college and Dr. Raimondo worked to ensure that students’ freedom of speech was protected and that the student demonstrations were safe and lawful, and they attempted to help the plaintiffs repair any harm caused by the student protests.”

The lawsuit was yet another flashpoint in the nationwide controversy surrounding universities and political correctness. Oberlin, in particular, has provoked conservatives' ire for its apparent deference to politically correct ideas.

Back in 2016, for example, actress and Oberlin alumnus Lena Dunham drew attention to an incident in which students complained that the college had engaged in cultural appropriation by serving sushi and other food.

Other colleges, like the University of Illinois, faced lawsuits as they imposed what some considered to be politically correct speech codes and chilled students' First Amendment rights through regimes known as "Bias Response Teams."

They should take the 33M and fund a legal defense fund against these social justice warriors.

Like the Colorado Masterpiece baker getting raked over the liberal coal yard....

That is what I would do.

To quote Archie Bunker, "I'd hire a company of seven savage Jewish lawyers to go after them."

Ok...when do they get paid? Can it be in PM's?
Unfortunately the IRS is gonna get a piece of the action. They always do. I do believe the Punitive Award is NOT taxable, but I may have that reversed. ID'tK
I do know I had to pay taxes on a court case award years ago.
