N.J. state trooper stops a driver for tailgating. He ends up searching the man's underwear for pot.

A New Jersey state trooper donned latex gloves and reached inside a young man’s underwear as the two stood on the shoulder of a heavily traveled Burlington County highway after a motor vehicle stop last year, according to court documents and police dashboard and body cam video obtained through a recent open public records request.

In the videos, Trooper Joseph Drew is first shown stopping a motorist in rural Southampton for tailgating. When he approached the car, the trooper said he smelled marijuana and ordered the driver to hand it over. When the 23-year-old driver said he did not have any drugs, the trooper ordered him and his passenger out of the car, placed the two men in handcuffs, and searched the vehicle. The trooper also checked the driver’s pockets and socks, and found no drugs. According to the video footage, he then says, “If you think this is the worst I’m going to do, you have another thing coming, my friend.”

A few minutes later, he is seen putting his gloved hands down the man’s pants. In the disturbing footage, the driver is seen and heard screaming that he is being raped as the trooper reaches into his underwear and touches his crotch and buttocks. At one point, the man tells the trooper, “You better hope this is legal.”

During the search, which lasted nearly four minutes, trucks and cars passed by.


The man, whose name is being withheld by the Inquirer and Daily News because the newspapers do not identify victims of alleged sexual assaults without their permission, later said in an affidavit that the trooper “groped my genitalia and moved my private parts around,” and touched the crack of his buttocks. “It was the most humiliating experience I’ve ever been through, also due to the fact that people were driving by very slowly,” he said.


The videos were obtained by John Paff, who runs the New Jersey Libertarian Party’s Open Government Advocacy Project. He frequently requests court documents and police videos and posts them on his website, NJ Open Government Notes. The videos include footage from the dashboard and body cameras of the trooper and his backup, Trooper Andrew Whitmore.

Lt. Theodore Schafer, a state police spokesman, said the agency has launched an internal affairs investigation into the traffic stop, which occurred on March 8, 2017. The troopers are still on active patrol pending the results of the probe, Schafer said. He said the troopers have been with the state police about three years.

Schafer said the incident came to the attention of the state police in late January, when the motorist filed a tort claim – or notice of intent to sue – contending that his civil rights were violated during the roadside search.

Arthur Lang, a Lakewood attorney, filed the tort claim in Superior Court in Burlington County, asking a judge to waive governmental immunity and allow the motorist to sue the state police, the two troopers on the scene, and a desk sergeant who he said approved the roadside search against his client. Lang is seeking court permission to pursue the case even though the 90-day filing deadline has passed.

The tort claim says the state police delayed providing the dash-cam videos and other materials surrounding the motor vehicle stop. It also says the trooper “violated the attorney general’s strip search and body cavity search requirements and procedures,” which were put in place in 1993 and then updated in 1995.

Lang said he may later file a claim in federal court. He declined further comment.

The state Attorney General’s Office did not respond immediately to requests for information on the state’s policy on strip searches and body searches. The state police spokesman said his agency needed more time to get the information.

The motorist could not be reached. While in handcuffs, he told the trooper that he was on his way back to work that afternoon as a drywall installer and asked the trooper to hurry with the search of the vehicle so he could get there on time.

When the trooper said he planned to take him to the station for a body search, the man asked if he was being charged and whether such a search was legal. He said that if he had no choice about the search, he wanted it to be conducted in front of the dashboard camera.

The tailgating charge was dismissed in Southampton Municipal Court at the trooper’s request, according to the tort claim. In the videos, the trooper hands the motorist the tailgating ticket along with a paper listing his name and badge number, and invites him to report the incident “if you honestly believe your rights were violated or I was unprofessional.” Then, as he walks away, he says, “Hope you get a lot of hits on YouTube.”

Philly cops waiting to testify in court cost city millions in OT

Uniformed police officers routinely crowd the hallways of the Criminal Justice Center, sitting on benches reading or looking at their phones as they wait to testify. Others are in small anterooms outside courtrooms, chatting with colleagues or preparing with prosecutors.

The pay meter is running all the while.

In the first seven months of fiscal year 2018, which ends June 30, police officers racked up $12 million in overtime related to testifying — or just waiting to testify — in court. That’s one of the biggest reasons, with five months remaining in the fiscal year, the Police Department had already burned through its entire $57 million overtime budget.

The department is not alone. The Pennsylvania Intergovernmental Cooperation Authority (PICA), the city’s fiscal watchdog board, estimates that the city is on pace to spend $30 million more than its $135 million overtime budget for fiscal year 2018. The Sheriff’s Office and Fire and Streets Departments are among those expected to go over budget.

But Police Department overtime has garnered the most attention during early City Council hearings on the next fiscal year’s budget. PICA is also considering a study into reducing police overtime expenses, with a particular focus on the role of officers’ court time.

“One of our largest drivers of overtime is preliminary hearings because officers are required to come to [court] for those hearings,” Brian Abernathy, first deputy managing director, said during a budget hearing last week. “Part of the conversation with the courts is to see whether they would be willing to have some preliminary hearings back in the districts, which would in fact reduce overtime significantly. But again that’s a longer conversation.”

During an editorial board meeting with the Inquirer and Daily News last month, Police Commissioner Richard Ross said he has spoken to District Attorney Larry Krasner about the possibility of moving preliminary hearings back to six regional police districts, as was done until 2010 — a step that could cut down on the time officers spend just getting to and from hearings, and out of their districts. (Most of the hearings occur at one of three Center City locations: City Hall, the Criminal Justice Center, or Family Court.)

“He said he’s not opposed to it, but of course we have to go to the judges and public defender and see if they aren’t opposed,” Ross said.

The judges, through a spokesman for the First Judicial District, declined to answer questions on the issue.

“The courts have no control over police overtime,” spokesman Marty O’Rourke said.

Harvey Rice, PICA’s executive director, said that when he met with court personnel last summer about police overtime, they pointed the finger at police and the District Attorney’s Office. The Kenney administration and the District Attorney’s Office also pointed fingers.

“That meeting got very contentious and heated in regards to who was responsible for court overtime and what measures needed to be put in place that could help alleviate that,” Rice said in an interview last week.

Rice plans to ask the PICA board at its April meeting to hire a consultant to study police overtime. Based on the meetings PICA staff has had with officials so far about court-related police overtime, he said several issues came up that should be studied further.

For example, Rice said, officers appearing in court used to check in and out with a fingerprint system, but now, court liaisons, often police officers on temporary desk duty, sign subpoenaed officers in and out — a potentially less precise method.

Rice also said some judges reported some police officers’ request to be called last to testify, therefore prolonging their time on the clock.

Then there is the disagreement on scheduling. Rice said that both the First Judicial District and District Attorney’s Office said that the Police Department’s schedule is coordinated with the case processing system and that officers are not generally asked to appear when to do so would conflict with their work schedule.

But police officers said their work schedules hardly coincide with required court appearances.

Whoever is at fault, it doesn’t matter to the officers getting the extra money.

One who recently was waiting to be called in a trial said he had been sitting outside the room for the better part of a week. Even if he never took the stand, he cracked to a court officer during a break one day, at least he’d be able to afford a new pair of snakeskin boots.

Payroll records indicate that the Police Department’s largest overtime earners are generally detectives, many of whom earn tens of thousands of dollars each year on top of their salaries. In 2017, according to payroll records, seven detectives each earned more than $75,000 in overtime. In 2016, five of the city’s 10 highest overtime earners were detectives; it was not clear how much of that extra pay was tied to court appearances.

One homicide detective, who declined to be identified without department authorization, said the money reflects the workload most investigators shoulder. Homicide detectives often work extended shifts after being assigned a new murder investigation, and after they spend time in court for cases they previously helped to build, many return to the unit to continue investigating their open cases.

“You can’t put a price on staying [at work] and clearing [an investigation],” he said.

John McNesby, president of Fraternal Order of Police Lodge 5, the officers’ union, said the cops who earn lots of overtime are generally the ones who work long hours and make a lot of arrests, which results in more court notices to testify.

“The more active you are, the more overtime you’re going to make,” McNesby said.

Court time drives about 20 percent of police overtime spending. An additional $45 million in overtime has already been put toward crime fighting, security details, protests, and special events. (At least $13 million is expected to be reimbursed by private entities that requested police presence.)
It is unclear how much money would be saved if preliminary hearings were held in the districts.

“We do not have a targeted reduction at this point because, again, the system is not just us, it’s also the district attorney, it’s also the courts,” Abernathy said. “We need to be able to advance that conversation further down the road before we can identify exactly what those savings will be.”

One thing is for sure: The city doesn’t expect police costs to decrease in fiscal year 2019, Budget Director Anna Adams said.

Philadelphia’s black police commissioner is defending his officers’ decision to arrest two black men at a Starbucks that prompted social media users to call the incident “racist.” Videos posted online show officers handcuffing the men in the downtown establishment Thursday. Commissioner Richard Ross said Starbucks employees called police to say the men were trespassing. He said they came in to use the restroom but were denied because they hadn’t bought anything.

Ross, who is black, said police asked the men to leave three times but they refused. They were arrested and released. Ross said his officers “did absolutely nothing wrong.” There was no mention of the white man in the video who said he was meeting with the men. He called the arrest “ridiculous” on video. Starbucks tweeted an apology Saturday.

In an attempt to truly stay who I am and absolutely continue to advocate for police officers, I am reaching out to you personally, in hopes you will hear what I have to say.

Over the last 9 months you have participated on a facebook forum filled with police officers, both retired and active and citizens as well. You have been attacking me, my character, my name, my parents, sister and friends all based on the half miss-given information of men who have had limited interactions with me, and have have stated they have an agenda against me.

Having never had met you, I dismissed your actions as those of someone with a personal issue against me for reasons that I will never understand.

But seeing as you continually have attacked my credibility, specifically my termination for department policy violations, I want to come to you first with this before I move forward.

As an active sworn police officer for the Chicago Police Department, you are in daily violations of sections 4, 8, 9 and 42 of Rules and Regulations of the Chicago Police Department Adopted and Published by the Police Board Article V. Rules of Conduct.

Rule 4: Any conduct or action taken to use the official position for personal gain or influence.

Rule 8: Disrespect to or maltreatment of any person, while on or off duty.

Rule 9: Engaging in any unjustified verbal or physical altercation with any person, while on or off duty. COMMENT: Rules 8 and 9 prohibit the use of any excessive force by any member. These rules prohibit all brutality, and physical or verbal maltreatment of any citizen while on or off duty, including any unjustified altercation of any kind.

Rule 42: Participating in any partisan political campaign or activity.

I have been notified of your contacting organizations I am involved with on an professional level, stating that you would, "I’ll be sure to spread the word on your poor choice for an endorser" as well as your daily commenting on my family and friends on a facebook page clearly dedicated to campaign purposes.

I am reaching out to you first. I have never met you, nor have I had any contact with you prior to this correspondence.

On a personal level, as someone who paid a price far greater than you, in order to fight for all of you, I am embarrassed that you represent the oath that we both swore to, but I do not know you, so to say so is a misjudgment of your character on my end and I truly hope you are righteous and honor the profession we both love.

We swore the same oath and our honor was to hold ourselves to a higher standard. Engaging in an online cyber bullying campaign against my family is proof that we have a problem with police officers in this nation, and again, I truly hope that this is not in your character. If you treat citizens like this while you are still sworn, I fear how you have conducted yourself on the street, again with the truest hopes that this is not your standard character.

I am requesting that you cease all comments about my family and friends immediately. We have taken screen shots of all of your posts, comments and displaying of yourself in Chicago Police uniform as a representation of the Chicago Police Department.

I violated department policy and I owned up to it. You are violating yours on a daily basis.

I am reaching out to you before I file an official complaint with your supervisor as well as take all of this information to Kim Foxx's office, Chicago Police Bureau of Professional Standards, the media and anti-bullying campaigns to show that an active Chicago Police Officer is violating the ethics, morals and standards that she is held to.

I do not want to pursue this, however, your conduct is the exact thing I spoke out about and lost my job over, and continue to fight against on a daily basis.

Bottom line, I am giving you the courtesy you did not give me before attacking myself and my family and asking you as a professional to stop and remember that I have gone through everything I have gone through so that I can do what I can to keep officers like you out of the media's attack. Stop or I will move forward.

I ask that you actually look into what I have been through instead of trusting all of the half truth information that you have been fed.

Two Black Men Arrested for Acting Entitled At Starbucks. Here is another example of African American men feeling that they are above the law. A major issue in the black community is the lack of respecting authority. This situation would have been a non-issue if these two black men would have just simply followed Starbucks protocol like everyone else. Also, If white people were not so afraid of being deemed racist or even feel a high level of white guilt, this video would have never been recorded. Starbucks being the cowardice organization they are, apologized for no reason. What a shame. This isn't helping black people or anyone in America for god's sake.
