Justice Dept. Watchdog Has Evidence Comey Probed Trump, on the Sly

It is one of the most enduring and consequential mysteries of the Trump-Russia investigation: Why did former FBI Director James Comey refuse to say publicly what he was telling President Trump in private – that Trump was not the target of an ongoing probe?

That refusal ignited a chain of events that has consumed Washington for more than two years – including Comey’s firing by Trump, the appointment of Special Counsel Robert Mueller, and ongoing claims that Trump obstructed justice.

Now an answer is emerging. Sources tell RealClearInvestigations that Justice Department Inspector General Michael Horowitz will soon file a report with evidence indicating that Comey was misleading the president. Even as he repeatedly assured Trump that he was not a target, the former director was secretly trying to build a conspiracy case against the president, while at times acting as an investigative agent.

Two U.S. officials briefed on the inspector general’s investigation of possible FBI misconduct said Comey was essentially “running a covert operation against” the president, starting with a private “defensive briefing” he gave Trump just weeks before his inauguration. They said Horowitz has examined high-level FBI text messages and other communications indicating Comey was actually conducting a “counterintelligence assessment” of Trump during that January 2017 meeting in New York.

In addition to adding notes of his meetings and phone calls with Trump to the official FBI case file, Comey had an agent inside the White House who reported back to FBI headquarters about Trump and his aides, according to other officials familiar with the matter.

Although Comey took many actions on his own, he was not working in isolation. One focus of Horowitz’s inquiry is the private Jan. 6, 2017, briefing Comey gave the president-elect in New York about material in the Democratic-commissioned dossier compiled by ex-British intelligence officer Christopher Steele. Reports of that meeting were used days later by BuzzFeed, CNN and other outlets as a news hook for reporting on the dossier’s lascivious and unsubstantiated claims.

Comey’s meeting with Trump took place one day after the FBI director met in the Oval Office with President Obama and Vice President Joe Biden to discuss how to brief Trump — a meeting attended by National Security Adviser Susan Rice, Homeland Security Secretary Jeh Johnson, Deputy Attorney General Sally Yates and National Intelligence Director James Clapper, who would soon go to work for CNN.

In his recently published memoir, “A Higher Loyalty,” Comey denied having "a counterintelligence case file open on [Trump],” though he qualified the denial by adding this was true only in the “literal” sense. He also twice denied investigating Trump, under oath, in congressional testimony.

At the same time Comey was personally scrutinizing the president during meetings in the White House and phone conversations from the FBI, he had an agent inside the White House working on the Russia investigation, where he reported back to FBI headquarters about Trump and his aides, according to officials familiar with the matter. The agent, Anthony Ferrante, who specialized in cyber crime, left the White House around the same time Comey was fired and soon joined a security consulting firm, where he contracted with BuzzFeed to lead the news site's efforts to verify the Steele dossier, in connection with a defamation lawsuit.

DOJ Launches Antitrust Probe into Tech Giants


The Department of Justice (DOJ) on Tuesday announced it is opening a review into whether the United States’ biggest and most powerful technology companies have stifled competition or hurt consumers.
The federal agency’s antitrust division said in a statement that the sweeping inquiry will evaluate “whether and how market-leading online platforms have achieved market power and are engaging in practices that have reduced competition, stifled innovation, or otherwise harmed consumers.”

Further, the DOJ stated it will “consider the widespread concerns that consumers, businesses, and entrepreneurs have expressed about search, social media, and some retail services online.Amazon is one of the world’s largest online retailer, while Facebook has dominated the social media space over for a decade. For years, Google has operated the most popular search engine and dominated online advertising, a duopoly that Amazon is just now gaining a foothold against.

“Without the discipline of meaningful market-based competition, digital platforms may act in ways that are not responsive to consumer demands,” said Makan Delrahim, the Assistant Attorney General of the Antitrust Division. “The Department’s antitrust review will explore these important issues.”

It comes as a growing number of lawmakers have called for stricter regulation or even breaking up of the big tech companies, which have come under intense scrutiny following a series of scandals that compromised users’ privacy.Technology giants such as Amazon and Facebook have not commented on the development.

The DOJ’s announcement comes on the heels of a Washington Post report stating that the FTC will allege that Facebook misled users about its privacy practices as part of an expected settlement.

The federal business watchdog will reportedly find that Facebook deceived users about how it handled phone numbers it asked for as part of a security feature and provided insufficient information about how to turn off a facial recognition tool for photos.

Advertisers were reportedly able to target users who provided their phone number as part of a two-factor authentication security feature.

The FTC didn’t respond immediately to a request for comment. Facebook had no comment.

The complaints will reportedly be detailed in a settlement on Wednesday. Facebook will not be required to admit guilt but will have to submit to federal oversight, the newspaper reported.

Congressman Mark Meadows (R-NC) blasted the loser Democrats on Tuesday.

“House Democrats holding mock hearings, practicing 5 minute clips, and even setting up a social media “war room”… for a Mueller hearing on a collusion case that closed 4 months ago This is your House Democrat majority, spending their time as if they’re putting on a school play,” Meadows said.

House Judiciary Chairman Jerrold Nadler (D-NY) beat the impeachment drum on Sunday ahead of Mueller’s testimony to Congress.

Nadler said during his appearance on ‘Fox News Sunday’ that the evidence shows Trump is guilty of high crimes and misdemeanors.

“The [Mueller] report presents very substantial evidence that the president is guilty of high crimes and misdemeanors,” Nadler said.

Donald Trump has given the US attorney general permission to share classified information about the Russia investigation with Devin Nunes, the Republican House Intelligence Committee ranking member who has called for Justice Department and FBI officials to be jailed over the probe.

The US president said he had given William Barr “a total release” of documents relating to the investigation into Moscow’s interference in the 2016 election, and had also “given him authorisation to release it to whoever he wants”.

“He’s got everything; everything he needs, he’s got,” he told Sean Hannity in an interview on Fox News on Thursday night.

Mr Trump added: “He’s the attorney general of the United States, he’s has got a lot of very good people under him that I guess are involved and I gave them a total release. So, all of it’s been released and he has all of it.

“I’ve also given him authorisation to release it to whoever he wants, whether it’s his people or frankly perhaps people like Devin Nunes, who is a star.”

ACLJ Obtains Obama DOJ’s Immunity Agreements with Hillary Clinton Lawyers Cheryl Mills and Heather Samuelson to “Dispose” of Evidence and Refuse to Comply with Federal Law

The ACLJ has just obtained previously unreleased documents related to the Clinton investigation and immunity agreements given to top Clinton aids. These agreements reveal that James Comey’s Federal Bureau of Investigation (FBI) and Loretta Lynch’s Department of Justice (DOJ) granted immunity to Hillary Clinton’s aids and lawyers, Cheryl Mills and Heather Samuelson, from prosecution for anything found on their laptops violating multiple felony criminal statutes governing the mishandling of classified information and/or the removal or destruction of records, including Espionage Act provisions. Further, the DOJ and FBI also agreed to evade the statutory requirements of the Freedom of Information Act (FOIA) by purporting to deem the contents of the laptops as not under DOJ or FBI “custody or control.”

These laptops were critical to any meaningful investigation of Hillary Clinton’s handling of classified emails and records. According to the DOJ Inspector General, who identified these as the “culling laptops,” “[a]ll 62,320 emails pulled from the Clinton servers were stored at one time on these laptops.” Having taken control of these laptops, agreeing to severely limit its searches, agreeing to unlawfully shield the laptops from FOIA, then agreeing to dispose of the laptops, it appears the Comey FBI and Lynch DOJ did everything in their power to protect Clinton’s senior aids and lawyers from both criminal liability and public scrutiny.

While these immunity agreements and related news have been publicly discussed to some extent, the ACLJ has now obtained the actual documents so the public may see and judge them accordingly.

Latest FOIA Revelations Show A ‘FIX’ Of Hillary’s Exoneration

The American Centre for Law and Justice finally got some satisfaction from its numerous FOIA requests to the Department of Justice. It took a specific court order from a federal judge to release long-secret documents that might raise a few eyebrows among those who are still interested in matters pertaining to Hillary Clinton’s aides and the former secretary of state’s missing emails.

The ACLJ has obtained the DOJ’s infamous immunity agreements with Hillary Clinton’s top aides Cheryl Mills and Heather Samuelson – documents previously unreleased to the public and which include the DOJ attempting to enter an agreement not to comply with the requirements of FOIA, and which confirm it agreed to “dispose” of evidence, including Mills’ and Samuelson’s “culling laptops” which contained all of the missing emails from Hilary Clinton’s private homebrew server.

The immunity agreements signed by Mills and Samuelson are, to say the least, overly generous to their legal interests:

As we have advised you, we consider Cheryl Mills to be a witness based on the information gathered to date in this investigation. We understand that Cheryl Mills is willing to voluntarily provide the Mills Laptop to the Federal Bureau of Investigation, if the United States agrees not to use any information directly obtained from the Mills Laptop in any prosecution of Cheryl Mills for the mishandling of classified information and/or the removal or destruction of records as described below.

That might be fairly standard. But what’s highly unusual is that the content of those laptops remains the private property of the aides. In other words, some of the content is immune from FOIA requests.

This became clear in a separate letter obtained by ACLJ:

The terms “custody and control” is a FOIA term of art. So, in other words, the DOJ/FBI purported or attempted to agree itself out of the requirements of FOIA, so that nothing on Mills’ or Samuelson’s culling laptops would be subject to FOIA. This agreement is particularly noteworthy given what former FBI lawyer Lisa Page told the DOJ Office of Inspector General:

[T]hese are the State Department’s records. And if the Secretary in the first place had actually followed normal protocol, every single one of these emails, whether personal or work-related would have been in the State Department’s possession, and there would be no attorney-client discussions happening with respect to the sort of this material.

In other words, the DOJ voluntarily agreed to refuse to comply with the requirements of FOIA as to documents that were clearly within the purview of FOIA requests and had otherwise been prevented from being FOIA’d by being stored on Clinton’s private server.

''The DOJ agreed that the FBI would “dispose” of Mills’ and Samuelson’s laptops after the search. According to the agreement:

As soon as the investigation is completed, and to the extent consistent with all FBI policies and applicable laws, including the Federal Records Act, the FBI will dispose of the Device and any printed or electronic materials resulting from your search.

In other words, after agreeing to limit its search of Mills’ laptop to (1) only a certain method of searching; (2) only for certain email-related files; and, (3) only files created within a certain time-frame, the DOJ/FBI agreed to dispose of the laptop – meaning anything else embarrassing, negative or potentially implicating on the laptop – including official State Department records – would be destroyed and never be exposed. (Emphasis mine)

According to the John Solomon interview:

The Comey memos in question were classified CONFIDENTIAL by the FBI after the fact, so even if JC were found culpable, he would only get a slap on the wrist.

So Barr chose NOT to charge him for that particular offense.

But word on the street is that Comey has committed much worse, and treasonous crimes.
