Judge limits Gov. Newsom's emergency rule-making

SACRAMENTO, Calif. —
A California judge on Friday sided with Republican legislators who said Gov. Gavin Newsom overstepped his powers with dozens of emergency orders during the coronavirus crisis that changed everything from how public meetings are conducted to when tenants can be evicted.
Sutter County Superior Court Judge Perry Parker only halted one of the orders, involving the November election, but ordered Newsom to refrain from new orders that might be interpreted as usurping the Legislature's responsibilities.
The judge appeared to adopt without changes a proposed order submitted to him by GOP Assemblymen James Gallagher and Kevin Kiley, who challenged the election order.

Parker barred Newsom “from further exercising any legislative powers in violation of the California Constitution and applicable statute, specifically from unilaterally amending, altering, or changing existing statutory law or making new statutory law.” He scheduled a hearing for June 26 to consider issuing a preliminary injunction.
“This is a victory for separation of powers,” the lawmakers said in a joint statement. “The governor has continued to brazenly legislate by fiat without public input and without the deliberative process provided by the Legislature. Today the judicial branch finally gave him the check that was needed and that the Constitution requires.”

Erwin Chemerinsky, dean of the law school at the University of California, Berkeley, said the judge's order “says only that the governor cannot issue orders that violate the law.”
“The paragraph in the order is vague, but I think it clearly does not forbid all executive orders, just those that are unconstitutional or violate statutes,” he said.

HOW THE DEMOCRATS COLLUDE TO ENABLE VOTER FRAUD
One of the most pernicious phenomena of modern times is the collusive lawsuit. This is how it works: a left-wing organization sues a government agency that is also controlled by the left. The lawsuit alleges that the agency is obliged to do something that the agency would like to do, but the Democrats can’t get it passed. Then the parties–supposedly adverse, but actually in collusion–“settle” the case by having the agency agree to do what it wanted to do all along. If all goes well, a court enters an order enforcing the settlement. So the net effect is that a policy that the Democrats couldn’t get passed is now a court-ordered mandate. This happens often.
In Minnesota, Democrats are colluding to enable voter fraud in the upcoming primary election. This presumably is a warmup for the same effort they will make to enable fraud in the general election in November. With many believing that President Trump has a good chance to carry Minnesota after coming close last time, the Democrats are taking no chances.
The case is League of Women Voters v. Simon. The League of Women Voters, a solidly Democratic organization, is “suing” Minnesota’s Secretary of State, left-wing activist Steve Simon. The lawsuit seeks to suspend Minnesota’s election laws, ostensibly on account of COVID-19, so that persons mailing in absentee ballots won’t need to satisfy the statutory requirement of a witness to verify their identity. Without that requirement, voter fraud will be even easier than it is at present. If a Democrat finds a ballot lying around, as will happen many thousands of times in Minnesota, where the voter rolls include hundreds of thousands of names that are dead or otherwise not eligible voters, he can fill it out and send it in, no questions asked.
Democratic Secretary of State Steve Simon, who consistently abuses his office to facilitate voter fraud, quickly agreed to the “settlement” that his party wanted.
If you think this is a scandal, you are right. Happily, the Trump presidential campaign and Minnesota’s Republican Party hired excellent lawyers to intervene in the case and seek to block the proposed “settlement.” I have embedded their Opposition to the Proposed Consent Decree below. Here are a few quotes that demonstrate how the Democrats tried to achieve an illegal result by “settling” a collusive lawsuit.
This voter fraud effort is part of a nationwide campaign:
Democrats now contend that, in light of COVID-19, their legislative agenda is required by the Constitution. The Democratic Party (through its law firm, Perkins Coie) has filed COVID-19 lawsuits in virtually every swing State, including Minnesota. See Where We’re Litigating, Democracy Docket, bit.ly/2V0rF7k. Allied groups have bolstered the Democrats’ effort by filing dozens of copycat suits across the country. For example, the League of Women Voters brought this suit in federal court, while the Alliance for Retired Americans (backed by the Democratic Party) and the NAACP (backed by the ACLU) brought overlapping lawsuits in state court.​
The good news: “When these COVID-19 lawsuits face adversarial litigation, they usually fail.” Many citations at the link. This is why a collusive “settlement” is the easiest path to voter fraud.
In this case, the fraudulence of the “settlement” is obvious:
Defendant [the Secretary of State] filed an answer on June 9, 2020. Doc. 22. In it, he denied all Plaintiffs’ material allegations. Doc. 22 ¶¶7, 12, 62, 65, 80, 81, 87, 95, 100, 102, 109, 111. He also denied that heightened scrutiny applied to the witness requirement and argued that the requirement would survive any level of judicial scrutiny. [The cases cited by Intervenors indicate that this is clearly correct.] Doc. 22 ¶¶106, 107. And he asserted that Plaintiffs failed to state a claim upon which relief could be granted. Doc. 22 at 40.​
All of which were sound legal arguments, as the many cases cited in the Intervenors’ brief show. But the Secretary of State gave away the store, on purpose:
At some point in the next seven days, Defendant made a sharp U-turn. On June 16, the parties jointly submitted a proposed consent decree to the Court. Under that decree, Defendant would totally refrain from enforcing the witness requirement and concede to all four kinds of relief that Plaintiffs sought for the August primary. Doc. 24 at 6. Further, Defendant would concede that “Plaintiffs made a sufficiently strong showing on the merits of the claim”—a position directly contrary to the one he took in his answer a week earlier. Doc. 24 ¶20.​
In short, Minnesota’s Democratic Secretary of State colluded with a Democratic plaintiff to rewrite Minnesota’s election laws to facilitate voter fraud for the benefit of the Democratic Party.
The Democrats’ motion to approve their collusive settlement will be argued in federal court tomorrow. Given the overwhelming authorities cited in the Intervenors’ brief, I assume the judge will disapprove the settlement. But this is an excellent example of the evils of collusive litigation. It is a huge problem that can be mitigated only to the extent that the courts are not controlled by Democrats.

NJ City Officials Charged After 1 In 5 Mail-In Ballots Found To Be Fraudulent In Election



New Jersey Attorney General Gurbir Grewal filed voter fraud charges Thursday against two Paterson city officials who allegedly engaged in a mail-in ballot scheme in connection to a special election in May.



Grewal levelled the charges against Paterson City Councilman Michael Jackson, Councilman-Elect Alex Mendez, and two other men after the Postal Inspection Service warned Grewal’s office that hundreds of mail-in ballots were found in a Paterson mailbox, InsiderNJ reported Thursday.



The attorney general’s Office of Public Integrity & Accountability (OPIA) began a probe after the Postal Inspection Service issued the warning. Paterson authorities decided to conduct the May 12 special election through mail-in ballots due to the COVID-19 pandemic, which has reportedly killed more than 124,000 people in the U.S. (RELATED: Tucker Carlson: Mail-In Voting And Ballot Harvesting ‘Massively Expands The Potential For Voter Fraud’)



Only 13,557 of the 16,747 vote-by-mail ballots in Paterson were counted, a local NBC affiliate in New York reported in May. More than 800 ballots in Paterson were invalidated for appearing in mailboxes tethered together. One mailbox reportedly had hundreds of ballots tied together.

The board of elections disqualified another 2,300 ballots after concluding that the signatures did not match voting records.



One Paterson woman named Romana Javier, after NBC showed her a list of people who allegedly voted on her block, told the channel that she never received a ballot and did not vote. “We did not receive vote-by-mail ballots and thus we did not vote,” she said. “This is corruption. This is fraud.”



The potential for fraud as a result of state and local officials resorting to mail-in ballots has become a topic of conversation among conservatives. Twitter flagged one of President Donald Trump’s tweets for suggesting in May that California’s mail-in ballots will be “substantially fraudulent.”

United States Attorneys Available to Receive Election Complaints



Richard P. Donoghue, the United States Attorney for the Eastern District of New York, and Audrey Strauss, the Acting United States Attorney for the Southern District of New York, announced today that special telephone numbers have been set up to receive complaints of possible violations of federal election laws relating to tomorrow’s primary election in New York City and other counties in their districts.



The United States Attorneys said that their Offices will be available to receive complaints at the following numbers on Tuesday, June 23, 2020:



(646) 369-4739 (for Manhattan, Bronx, Dutchess, Orange, Putnam, Rockland, Sullivan, and Westchester counties) and



(718) 254-6790 (for Brooklyn, Queens, Staten Island, Nassau, and Suffolk counties)



In addition, complaints of possible violations of federal election laws may be made directly to the Federal Bureau of Investigation at (212) 384-1000.



The Department of Justice has an important role in deterring election fraud and discrimination at the polls, and combating these violations whenever and wherever they occur. The Department’s long-standing Election Day Program furthers these goals, and also seeks to ensure public confidence in the integrity of the election process by providing local points of contact within the Department for the public to report possible election fraud and voting rights violations while the polls are open on Election Day.

Voting By Mail

In July, a new law was passed to allow all registered voters in Massachusetts to vote by mail in any 2020 election, with no excuse needed.



As required by the new law, a Vote by Mail application will be mailed to every person who was registered to vote by July 1 and who had not already requested an absentee ballot for the State Primary or for all elections this year. A second mailing will be sent out in September to all voters who have not already applied for a Vote by Mail ballot for the November election. The applications are pre-addressed to your local election official and no postage is necessary.



Vote by Mail applications must be delivered to your local election office no later than 4 business days before the election. For a State Primary ballot, your application must reach your local election office no later than August 26. For a State Election ballot, your application must reach your local election office no later than October 28.



If you wish to vote by mail, you are strongly encouraged to return your application as early as possible, to make sure that you will receive your ballot in time to return it and have it be counted.



Vote by Mail applications are available for download and may also be requested by contacting the Elections Division.

To assist with limiting crowding at polling places, there will be additional days of early voting this year.

In-person voting for the November 3 State Election will take place over 15 days, with 14 days of early voting being held October 17-30. All cities and towns will be required to offer early voting on Saturday, October 17, Sunday, October 18, Saturday, October 24 and Sunday, October 25.



Early voting schedules and locations will be posted at www.MassEarlyVote.com at least one week before early voting begins.

Emergency Ballots

If you have been admitted to a healthcare facility within 7 days of an election, or you have been instructed by a medical professional or public health official to self-quarantine in your home within 7 days of an election, you may use the absentee ballot application to designate someone to pick up your emergency absentee ballot, deliver it to you, and return it to your local election official.



There is no deadline to submit an application for an emergency ballot, but your ballot must be returned to your local election office by the close of polls.

Town Elections

A new law has been passed which allows towns to reschedule their annual town elections, which are usually held between February 1 and June 30. Town elections must now be held on or before August 1. You should contact your town clerk for more information about the date of your town election.



No-excuse early voting by mail is allowed for all local elections being held on or before August 1, 2020. You may apply now for your mail-in early ballot.



If your town's election has been moved, ballots for the original election date will still be valid. If you have already submitted an absentee ballot, that ballot will be counted.

Candidate Nomination Papers

The Massachusetts Supreme Judicial Court has ruled that, due to the difficulty of obtaining signatures on nomination papers during the current pandemic, the following accommodations shall be made for non-party candidates for federal office:



The number of required signatures for ballot access will be cut in half;

An “electronic signature,” which is the voter's hand-written signature, either on paper or using a mouse or stylus on an electronic document, will be accepted on printed nomination papers.

Number of Signatures Required

In accordance with the SJC ruling, the number of certified signatures required for non-party candidates for federal office to be placed on the 2020 State Election ballot shall be:



President and Vice President — 5,000



U.S. Senator — 5,000



U.S. House of Representatives — 1,000



Electronic Signature Gathering

The Supreme Judicial Court has ruled that signatures gathered electronically may be acceptable for certification, though the nomination papers must still be submitted to local election officials and the Secretary of the Commonwealth on paper.



Acceptable “electronic signatures” include signatures signed on a scanned nomination paper using a mouse, stylus, or finger. Signatures are also acceptable if they are signed by hand on a nomination paper which has been scanned and returned to the campaign electronically. Typed signatures are not acceptable.



Please note that nomination papers cannot be submitted to local election officials or the Secretary of the Commonwealth's office electronically. Papers must still be printed, back-to-front, and must be exact copies of nomination papers provided by this office.



Additional guidance on “electronic signatures” can be obtained from the Elections Division.



Submission

Because some city and town halls are currently closed to the public, candidates are encouraged to submit nomination papers to their local election offices by mail, if enough time remains before the deadline. If you are mailing nomination papers, we recommend the use of some tracking service, in case they are mis-delivered. If you would like the papers returned to you by mail, include a pre-addressed postage paid envelope for the clerk to use to return them to you.



Remember that postmarks are not sufficient for nomination paper deadlines. The papers must be in the local election office by 5 p.m. on the date of the deadline!



If you need to file your papers in person, you should contact the local election official for information on their availability. They may ask you to call when you arrive, so they can meet you outside, or they may request that you leave your nomination papers in a drop box. If you are leaving nomination papers in a drop box, be sure to include your contact information, so the clerk can get in touch with you when the papers are ready to be picked up.



The Secretary of the Commonwealth's office remains open to the public during regular business hours for the filing of nomination papers.

The Supreme Court on Thursday declined to reinstate the vote of nearly one million felons in Florida.



The court declined to revisit a lower court ruling that stops felons with outstanding court-imposed debt from registering to vote.



It’s safe to say Democrats believe the felon vote will help their chances in the Sunshine State.

The Supreme Court on Thursday let stand a lower court ruling that could strip voting eligibility from up to 1 million Florida felons who have completed their sentences but have yet to pay outstanding fines, restitution and other fees.



In an unsigned opinion, the conservative-majority court declined to revisit a federal appeals court ruling that permits Florida to stop felons with outstanding court-imposed debt from registering to vote as a July 20 primary election registration deadline approaches.



Three of the court’s more liberal justices, Sonia Sotomayor, Ruth Bader Ginsburg and Elena Kagan, dissented.



“Under this scheme, nearly a million otherwise-eligible citizens cannot vote unless they pay money,” wrote Sotomayor, who called the policy a “voter paywall.”



The dispute concerns a 2018 amendment to Florida’s constitution that restored voting rights to those with felony convictions who had completed “all terms” of their sentences.



In April 2019 Jared Kushner announced that more ex-felons registered as Republicans as Democrats in Florida.

On Tuesday, President Donald Trump signed an executive order to prevent illegal immigrants from being counted for the purposes of re-drawing congressional districts after the 2020 census.

The order, “Ensuring American Citizens Receive Proper Representation in Congress” comes after the Supreme Court last year blocked a citizenship question from being included in the Census and sent the question back to lower courts, claiming that the administration’s reasoning for the question was insufficient.

President Thomas Jefferson first proposed a citizenship question in 1800, and one was added to the census in 1820 with a question that asked for the number of “foreigners not naturalized” in the household. Census forms including citizenship questions were common until 1950. On a global scale, as the Heritage Foundation notes “even the United Nations recommends that its member countries ask a citizenship question on their census surveys, and countries ranging from Australia to Germany to Indonesia all ask this question.”

According to an analysis from Unbiased America, Blue States with large illegal alien populations like California are benefiting massively in terms of representation due to their non-citizens.

Decades ago, the relatively small number of unauthorized residents in the U.S. meant that including them in the Census did not materially change the number of representatives each state was allocated. But today there are between 12 and 14 million people living here illegally, and the number is rising.​
As a result, states with large numbers of undocumented immigrants gain the advantage of additional representation in Congress. Based on the 2010 Census, the following states gained representatives because of the number of people illegally there:​
  • California: +6 representatives (11.3% of its current representatives)
  • Florida: +1 representative (4.0%)
  • New York: +1 representative (3.4%)
  • Texas: +1 representative (3.1%)
Because the House of Representatives is currently fixed by law at 435 members, states that have fewer illegal aliens and non-citizens lose representatives as a result. The following states have fewer representatives than they would if undocumented immigrants were not counted in the calculation:
  • Mississippi: -1 representative (25.0% of its current representatives)
  • Oklahoma: -1 representative (20.0%)
  • Kentucky: -1 representative (16.7%)
  • South Carolina: -1 representative (16.7%)
  • Wisconsin: -1 representative (12.5%)
  • Indiana: -1 representative (11.1%)
  • Michigan: -1 representative (6.7%)
  • Ohio: -1 representative (5.6%)
  • Pennsylvania: -1 representative (5.3%)
The Census is also used to allocate federal funds, and states with more illegal immigrants thus receive more from the federal government at the expense of those with smaller illegal alien populations.

Poll: Overwhelmingly Majority of Americans Don't Want To Vote by Mail in 2020 Election



A Washington Post/ABC News poll has found that a majority of Americans would prefer to vote in-person in the November presidential election.

Even with Democrats actively pushing universal vote-by-mail, ostensibly because of the coronavirus pandemic, nearly 60 percent of those polled said they want to cast their ballots in person.

Only 38 percent said they would want to vote via mail.

Absentee Ballots from South Carolina Found in Maryland

Twenty absentee ballots from South Carolina were accidentally sent to Maryland this week.

This isn’t the first mistake made by SeaChange Print Innovations, which prints and mails absentee ballots for 13 counties in South Carolina, the Post and Courier reports.

Some voters in Greenville County received the wrong absentee ballots this year for the Democratic presidential primary and a special election for sheriff, which were held 10 days apart, according to S.C. Election Commission spokesman Chris Whitmire.

Furthermore, some voters in Charleston County received ballots that were folded in such a way that would make them harder to read by scanning machines, Whitmire said.

Now, South Carolina election officials are considering cutting ties with the Minnesota-based printer.
